ELIGIBILITY: This contest ("Contest") is open only to students of public or private pre-school, elementary, middle, or high schools in Georgia, North Carolina, Maryland, South Carolina, Tennessee, Virginia, the District of Columbia and Delaware that are enrolled in Harris Teeter's Together in Education® (TIE) Program.
The following individuals are not eligible to enter, and their entries will not be considered in the Contest: Employees, officers, and directors of Harris Teeter, Ruddick Corporation, their affiliates, parents, or subsidiaries, and their advertising and promotion agencies, as well as immediate family members and others living in the same household with these individuals.
AS A CONDITION OF ENTERING THE HARRIS TEETER SING MY JINGLE CONTEST, EACH SCHOOL AND EACH INDIVIDUAL PARTICIPANT (AND IF UNDER 13 YEARS OF AGE, HIS OR HER PARENT OR LEGAL GUARDIAN) MUST REVIEW AND ACCEPT THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES BEFORE SUBMITTING AN ENTRY.
ENTERING THE CONTEST: NO PURCHASE IS NECESSARY TO WIN, and making a purchase does not increase your chances of winning. Simply create and submit, through your eligible school, an original video performance of the "My Harris Teeter" Jingle. You must be 13 years of age, or older, to submit an entry. To enter your video in the contest, log on to jingle.harristeeter.com ("Contest Web Site") between 12:01 a.m. ET on January 19, 2011 and 11:59 p.m. on April 19, 2011, and complete the contact and personal information in the website registration form. You will create a password, which you will use along with your email address to log back into the website at any time. You are solely responsible for the security of your password. You should take precautions to keep your password private to prevent any unauthorized use. Neither Harris Teeter nor any other person or entity will be responsible for any losses, damages or consequences you may suffer due to careless or unauthorized use of a password. Limit one registration account per person. All registrants must check the box saying "I have read and agree to the Official Rules" in order to register. You may then upload your video entry in the fields indicated at any time. Videos may be submitted in one of the following video formats: AVI, MOV, WMV, MP4, MPEG, FLV, 3GP and 3G2. By submitting a video entry, you affirm and represent that you have permission from the videographer (if other than entrant) and all parties appearing in the video (or their parent or guardian, if under the age of 13), to submit the video as a contest entry. You also affirm and represent that you have collected all parent/guardian waivers as described below and placed them on file at your eligible school.Harris Teeter is not responsible for any entrant's failure to timely or fully complete each step of the registration process. Registration must be completed by 11:59 pm on April 19, 2011 or your submission will not be entered into the contest.
All video submissions that comply with all Contest rules will be posted on the Contest Web site, jingle.harristeeter.com. Harris Teeter reserves the right not to post any video that it deems inappropriate in its sole discretion. Members of the public may vote once per day for their favorite video beginning as soon as the first video is posted and ending on April 19, 2011. One overall winning entry and four other winning entries (one per category, as described in the next sentence) will be chosen by a panel of Harris Teeter judges. The four categories of schools will be (i) preschools; (ii) kindergarten through fifth grade; (iii) sixth through eighth grade; and (iv) ninth through twelfth grade. Schools within each category will compete with one another to win the best of category prize for that category. Each member of the eligible school group or band must be in a grade corresponding to the grades within that category. The overall winning entry chosen by the judges will not be eligible to win the best of category prize in any category. Individuals may register and vote for a video to win the people's choice award. Details follow.
CONTENT REQUIREMENTS: Each entry must include a video of a student group or band from an eligible school singing the "My Harris Teeter" Jingle. Be creative! Each entry must be a newly created, original video prepared by an eligible school group or band.
CONDITIONS OF ENTRY: By entering the Contest, each school and each individual participant (and if under 13, his or her parent or legal guardian) agrees to these Official Rules, including any rules not listed here that may be added at Harris Teeter's sole discretion, and to the decisions of the judges and of Harris Teeter, which decisions are final and binding. Any person who is under the age of 13 must obtain consent from his or her parent or legal guardian to participate in the Contest. A consent form is available for download on the Contest Web site, jingle.harristeeter.com. All participants who are younger than 13 must have this consent form signed by a parent or legal guardian and on file at the school, and the school must be able to present the consent form at any time upon the request of Harris Teeter. If any school is unable to provide the consent forms signed by a parent or legal guardian, Harris Teeter may immediately disqualify the applicable video and remove it from Harris Teeter's website.
By entering the Contest and submitting a video, each member of a participating school group or band (and if under 13, his or her parent or legal guardian): (1) represents and warrants that the video submitted is his or her own original, legally created work and does not infringe any third party's intellectual property rights or rights of publicity or privacy; (2) represents and warrants that he or she owns all rights in the submission, including without limitation the copyrights in the recording and the performance; (3) irrevocably grants to Harris Teeter the unconditional, perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit, or otherwise use his or her video submission, including without limitation the recording and the performances included (as submitted or as edited by Harris Teeter in its sole discretion) and to use his or her likeness or photograph in any media, without any compensation or notice, whether or not such video submission is a prize winner; and (4) agrees to hold Harris Teeter harmless from any claims, damages, expenses, costs (including reasonable attorney fees) and liabilities brought or asserted by any third party against Harris Teeter arising from the entrant's submission or the individual's conduct in creating the submission, or otherwise in connection with the Contest.
All videos entered in the Contest will become the sole property of Harris Teeter. At its sole discretion, Harris Teeter may edit or alter any submission. Harris Teeter is not responsible for lost, damaged, or misdirected submissions under any circumstance. Harris Teeter will not return any submission, so please keep a copy of your submission if you want one. Harris Teeter reserves the right to destroy all submissions once the contest has ended.
PRIZES:
Prize winners are solely responsible for any taxes on their prizes and will receive an IRS Form 1099 for the value of their prizes.
JUDGING CRITERIA: All submissions will be screened for compliance with the Harris Teeter Sing My Jingle Contest Official Rules. Submissions that do not comply with the Contest rules or which, in the sole discretion of Harris Teeter, are otherwise inappropriate, will be disqualified.
The winner of the $10,000 grand prize and the $2,500 best of category prizes will be chosen by a panel of Harris Teeter judges. The judges will evaluate each video submitted based on creativity, talent, and effective use of the "My Harris Teeter" Jingle. The Harris Teeter judges' decisions are final for all matters relating to the Contest and are not subject to appeal.
The winner of the $1,000 people's choice award will be chosen by individuals who register by providing a valid e-mail address and other required information and vote at the Contest Web site, jingle.harristeeter.com, or who register and submit votes by mail. Each registered voter may vote only once per day.
At its sole discretion, Harris Teeter may travel to the schools submitting the winning entries to record the winning group or band performing the "My Harris Teeter" Jingle; provide a professional recording session for the group or band for the sole purpose of recording the "My Harris Teeter" Jingle; or use the originally submitted videos. Harris Teeter may, in its sole discretion, show the winning entries on Harris Teeter television commercials.
OTHER GENERAL RULES: All federal, state, and local laws apply. This Contest is void where prohibited by law.
Harris Teeter reserves the right, at its sole discretion, to disqualify any entrant who violates these Official Rules; tampers with or attempts to tamper with the entry process or the operation of the Contest or Web site; or acts in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
Prizes are not transferable. No cash or prize substitutions are permitted, except that Harris Teeter reserves the right to substitute prizes of comparable value.
If a winning group cannot be reached at the phone number submitted on the Contest Web Site, the prize will be forfeited and awarded to an alternate winning school.
All contest submissions become Harris Teeter’s property and will not be returned. Harris Teeter assumes no responsibility or liability for lost, misdirected, misplaced, damaged, illegible, incomplete, late, mutilated or postage-due contest submissions or for any act or failure to act regarding the transmitting, delay, or processing of entries, including any computer or malfunction involving the submission.
LIMITATION OF LIABILITY AND RELEASE:Harris Teeter, Ruddick Corporation, their affiliates, parents and subsidiaries, and the employees, officers and directors of all such parties assume no responsibility or liability for, and all entrants agree to release and hold them harmless from, any damages, injuries, losses, claims, or causes of action of any kind arising from participation in this Contest, the operation of this Contest or the acceptance, possession, use, or misuse of the prizes.
By participating in the Harris Teeter Sing My Jingle Contest, each school entrant agrees to release Harris Teeter, Ruddick Corporation, and each of their affiliates, parents, subsidiaries, and advertising and promotion agencies from all liability, claims, or actions of any kind for injuries, damages, or losses to persons or property that may be sustained in connection with: participation in any aspect of the Contest; receipt, ownership, or use of any prizes awarded; or any typographical or other error in the Official Rules, the administration of the Contest, or the announcement or offering of any prize.
Harris Teeter reserves the right, in its sole discretion, to cancel, modify, terminate, or suspend this Contest if causes beyond its control corrupt the administration, security, or operation of the Contest.
